Standing Strong for Immigrants in the Trump Era

At our immigration law office, we believe in the rights of immigrants and the power of the immigrant community in shaping a prosperous and just nation. That’s why we’re standing up to protect the rights of immigrants during this difficult time. Under the current Trump administration, we have seen many attacks on immigrant families, workers, and long-standing immigration policies. These changes affect people who have lived here for years, worked hard, raised children, and made the United States their home.

We want you to know: you are not alone. Our team is here to support you, guide you, and fight for your rights. The situation is constantly changing and you should check frequently for updates at our blog, the American Immigration Lawyer’s Association website, and your trusted news source of choice.

What’s Happening Right Now?

Since President Trump took office, we’ve seen big shifts in immigration policy. Many of these changes target specific communities based on misinformation and fly in the face of decades of standard practice as well as constitutional protections.

Attacks on Birthright Citizenship

The administration wants to end the right to US citizenship for people born in the US. This has been blocked for now, but would go against the 14th amendment and create uncertainty for millions.

Massive raids and deportations

ICE has increased arrests, even in homes, workplaces, and potentially schools. ICE has already started raids at work sites like the ones in LA and Omaha, as well as in immigrant communities like Nashville, TN, and in certain neighborhoods in Chicago and California. They are attempting to terrorize immigrants in these communities.

Unlawful deportations and deportations to unrelated countries

People have been deported in defiance of court orders and also some have been sent to other countries that are not their home country. Most notably, many people have been deported to El Salvador’s horrifying CECOT prison where abuse abounds.

DACA and TPS under attack

DACA and TPS under attack – Programs that protect young people and those fleeing danger are at risk or have been rolled back.

Asylum harder to get

Families fleeing violence are being turned away or forced to wait in unsafe conditions. Asylum-seekers are even being targeted at court hearings.

Long-standing immigration delays continue

Backlog and delays have been growing for years. The Trump administration is looking at cutting staff and could simply begin to deny applications to “eliminate” backlog.

Repression of Immigration-Related Protests

Recently, California, LA we have seen the National Guard called out to physically intimidate protests against ICE abuses. The National Guard and Marines are not designed for this, and Trump is only trying to stir up negative sentiment and create violent encounters.

Arrests at Immigration Court and Immigration Check-ins

ICE has recently started to arrest people when they go to their scheduled immigration courts and supervised meetings with ICE. Thus, immigrants are put in a “damned if you do, damned if you don't” situation. If they don't show up, they are later picked up and detained, and deported. However, if they do the correct thing and go to attend their court or supervision, they may be detained. This is pure evil and against the American legal system.

Why This Is So Dangerous

For decades, the US immigration system has been broken and not serving the needs of the nation or of immigrants. However, there was at least a basic recognition of people’s human and civil rights as outlined in our constitution.

These new policies:

Put everyone’s rights at risk.

When immigrant's rights to things like due process and their day in court are eroded, it opens the door to abuse citizens rights in the same way.

Abandon our responsibilities under international law.

We have a moral and legal obligation to welcome people fleeing war, deprivation, persecution, and government abuse. Asylum cases should be evaluated not summarily denied.

Dissuade legal immigration

Dissuade legal immigration of highly-skilled individuals worsening our labor pool and offers other countries a competitive advantage.

Discourage people from working government institutions

Discourage people from working government institutions, like law enforcement and public health and safety organizations.

Cause fear

Cause fear, anxiety, and trauma—especially for children.

But You Still Have Rights

Even under the Trump administration, immigrants have rights. The law is still on your side in many cases, and we are here to make sure you can use those rights.

You have the right to:

  • Speak to a lawyer before answering questions from immigration agents.
  • Remain silent if stopped or questioned by ICE.
  • Say “I do not consent to a search” if there’s no warrant.
  • Refuse to open the door unless an agent shows a signed warrant from a judge.
  • Apply for protection, asylum, visas, green cards, or citizenship if you qualify.
  • In many cases, to have your case evaluated by an Immigration Judge
Our law firm will help you understand your options, complete your paperwork the right way, and defend your case if needed.

Talk to a trusted immigration lawyer. Don’t rely on rumors or notarios. A good lawyer can explain what’s real and what’s not. Your lawyer should be a member of the bar in their state, like Richard, or if the person is not a lawyer, they should be on this list of accredited representatives.

Keep important papers in one place

This includes your passport, birth certificates, medical records, and immigration papers.

Make a plan for your family

Know who can care for your children and handle finances if something happens.

Know your rights

Practice what to do if ICE comes to your home or job. Carry a rights card with you.
